NO WARRANTIES, EXPRESSED OR IMPLIED, ARE MADE EITHER BY FEDERAL COACH OR BY THE SELLING DEALERS EXCEPT THE FOLLOWING WARRANTIES BY FEDERAL COACH.
FEDERAL COACH (hereinafter referred to as “Federal”) is the final stage manufacturer of an incomplete vehicle. This incomplete vehicle (hereinafter referred to as “chassis”) is manufactured and separately warranted by the chassis manufacturer. The warranties contained herein do not, therefore, extend to and cover any portion of the vehicle, or the contents therefore, which has been separately warranted by another manufacturer, except to the extent specifically required by any applicable lawful Federal law or regulation.
Limited Body and Parts Warranty: Federal warrants for a period of 3 year or 50,000 miles, whichever comes first after the date of delivery of the Federal Bus to the original retail customer, that the body and the parts manufactured by Federal will be free of defects in material and workmanship. Federal warrants the exterior fiberglass panels for 2 years unlimited to include roof sheets, front & rear caps, side panels against corrosion. This warranty (together with remedies for breach thereof) is limited, however, to the following: If the body or any part manufactured by Federal becomes defective during said period under normal use and service and the vehicle is brought to the workshop of any authorized Federal dealer in the continental United States, the dealer will, without charge, either repair the defective part or replace it with a new or factory reconditioned part, after obtaining authorization thereof from Federal.
Limited Exterior Structure Warranty: Federal also warrants that the steel body structure added by Federal to be free from defects in material or workmanship under normal use and service by the original retail purchaser for 5 years or 200,000 miles, whichever comes first after the date of delivery of the Federal Bus to the original retail customer. Steel body structure is defined as roof structure, perimeter wall structure and the steel floor structure. This warranty (together with remedies for breach thereof) is limited however, to the following: If the Steel body structure added by Federal is defective in material or workmanship under normal use and service and the vehicle is brought to the workshop of an authorized Federal dealer in the continental United States, the dealer will, without charge, either repair or replace the defective component after obtaining written authorization from Federal. This
warranty is limited exclusively to the Bus Body of the Federal Bus. The forgoing warranties do not cover (1) damage or deterioration due to normal use, wear and tear or exposure, (2) normal maintenance service, (3) damage or defects due to work done on the vehicle by someone other than an authorized Federal dealer, (4) damage or defects due to accident, abuse, or abnormal use, (5) damage or defects due to installation of additional equipment or appliances by anyone other than Federal factory personnel, (6) any vehicle on which odometer mileage cannot be readily determined, (7) external mechanical or chemical influences (regarding paint or body damage especially stone throw, air borne rust, industrial fall-out) acting on the
vehicle, (8) the motor vehicle being improperly handled or overtaxed, (9) the motor vehicle has been repaired or serviced by a third party who is neither a Federal dealer nor a Federal Authorized Service Operation and the owner is aware of this, (10) parts, not approved by Federal, having been installed into the vehicle or the vehicle being modified in a manner not approved by Federal, or (11) the instruction of Federal regarding operation, service and maintenance of the vehicle (for example in the Owner’s manual) not having been adhered to and especially the prescribed checks stipulated in the maintenance program not being carried out. Federal reserves the right to make a physical inspection by authorized factory personnel of the vehicle following any complaint and prior to any repair. The judgment of Federal as to the existence of any defect covered by this warranty shall be binding and conclusive upon all parties. The forgoing warranties are given in lieu of all other warranties, express or implied, including
ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE or any implied warranties otherwise arising from the parties’ course of dealing or the trade.
Federal makes no warranty whatsoever as to parts and labor, components and accessories not manufactured by Federal, including, but limited to the vehicle chassis, engine, drive train, suspension systems, alternators, regulators, heaters, air conditioners, and lock assemblies, audio systems, automotive cruise controls, upholstery, tires or batteries. Such components or accessories are covered by separate warranties of the manufacturers thereof. These other producers or their local service agents should be contacted for prompt corrective warranty action and for routine service and maintenance on such components or accessories. Federal does not adopt the warranties of other manufacturers or assume any responsibility with
respect to such warranties. Federal Coach has provided the customer with the warranties for those items which include procedures on how to obtain warranty service. Federal reserves the right to make changes or improvements at any time or from time to time in the design or upon Federal Bus products without any obligation to make a corresponding change or improvement in or upon the Federal Bus products previously manufactured by it.
In no event shall Federal be liable for any incidental or consequential damage (including but not limited to lost profits, loss of use, loss of time or inconvenience) resulting from a defect in, the use or misuse of, or the inability to use the vehicle. This exclusion applies regardless of whether the claim for such damages is based on breach of warranty, breach of contract, negligence, strict liability in tort or any other legal or equitable theory.
